KERJASAMA PENDIDlKAN DAN PELATIHAN
Pusat Pendidikan dan Pelatihan Pegawai Departemen Luar Negeri Republik Indonesia
dan Akademi Diplomatik Kementerian Luar Negeri Romania selanjutnya disebut
"Para Pihak";
BERHASRAT untuk memperkokoh hubungan bersahabat yang telah ada saat ini
melalui kerjasama di bidang pendidikan dan pelatihan diantara Para Pihak;
MENIMBANG perlunya untuk mengembangkan dan memajukan kerjasama
pendidikan dan pelatihan serta kerjasama diantara lembaga pendidikan dan pelatihan
Para Pihak;
MERUJUK pada Perjanjian Kerjasama Kebudayaan antara Republik Indonesia dan
Republik Rakyat Romania yang ditandatangani di Bucharest tanggal 14 April 1960.
SESUAI dengan hukum dan peraturan yang berlaku di kedua negara;
TELAH MENYETUJUI SEBAGAI BERIKUT:
Pasall
TUJUAN
Tujuan dari Memorandum Saling Pengertian selanjutnya disebut "MoU" adalah:
(1)
Memberikan suatu kerangka untuk kerjasama di bidang pelatihan untuk para
diplomat kedua negara. Kerjasama tersebut tidak boleh dilatarbelakangi oleh
pertimbangan komersil.
(2)
Menciptakan kondis i untuk memelihara hubungan berkala dan kerjasama
antara lembaga pelatihan diplomatik Para Pihak;
(3)
Memajukan pengembangan sumber daya manusia bagi para diplomat kedua
negara.
Pasal2
BIDANG KERJASAMA
Bidang kerjasama dalam Memorandum Saling Pengertian ini mencakup hal-hal:
(1)
Pertukaran informasi mengenai kurikulum dari kursus-kursus diplomatik
masing-masing, metode-metode pelatihan, seminar-seminar, lokakarya, atau
program-program sejenis lainnya mengenai bidang-bidang tertentu yang
menjad i kepentingan bersama;
(2)
Pertukaran tenaga pengajar dan siswa dengan tujuan untuk meningkatkan
profesionalisme mereka dan untuk membagi pengetahuan dan pengalaman
mereka masing-masing;
(3)
Pertukaran penerbitan dan materi-materi cetak lainnya yang diterbitkan oleh
Para Pihak atau lembaga-lembaga lainnya yang ada di negara masing-masing
di bidang kebij akan luar negeri, hubungan internasional, hukum internasional,
ekonomi internasional, ilmu politik atau subjek-subjek lainnya yang menjadi
kepentingan bersama;
(4)
Menyelenggarakan penelitian ilmiah bersama, simposium akademik,
konferensi, dan diskusi panel mengenai topik-topik yang menjadi kepentingan
bersama sebagaimana yang telah disetujui bersama dengan melibatkan para
ahli dari Para Pihak;
(5)
Menyelenggarakan program-program dasar dan kursus-kursus spesial dan
konsultasi bersama mengenai permasalahan menyangkut kursus-kursus bahasa
asing.
Pasal3
PELAKSANAAN
( l)
Para Pihak akan mcngadakan konsultasi secara berkala apabila dipandang
perlu untuk melaksanakan Memorandum Saling Pengertian ini;
(2)
Untuk melaksanakan Memorandum Saling Pengertian ini, Para Pihak akan
menyusun prosedur, rencana-rencana dan program-program kerjasama yang
telah direkomendasi dengan maksud untuk mencapai tujuan dari programprogram tersebut;
(3)
Pengaturan keuangan dan administrasi dari program-program tersebut di atas
dan program-program lain yang disetujui bersama yang dibuat berdasarkan
Memorandum Saling Pengertian ini akan ditentukan oleh Para Pihak
berdasarkan kasus per kasus untuk pelaksanaannya.
Pasal4
PENYELESAIAN SENGKETA
Setiap sengketa yang timbul antara Para Pihak mengenai penafsiran danlatau
pelaksanaan dari Memorandum Saling Pengertian ini akan diselesaikan secara
bersahabat melalui konsultasi dan perundingan.

PER UBAHAN
Memorandum Saling Pengertian ini dapat ditinjau kembali atau diubah setiap saat
dengan kesepakatan bersama Para Pihak. Perbaikan atau perubahan dimaksud mulai
berlaku pada tanggal yang ditetapkan oleh Para Pihak dan akan menjadi bagian tak
terpisahkan dari Memorandum Saling Pengertian ini.
Pasal6
MULAI BERLAKU, JANGKA WAKTU DAN PENGAKHIRAN
(1)
Memorandum Saling Pengertian ini akan mulai berlaku pada tanggal
penandatanganan;
(2)
Memorandum Saling Pengertian ini akan berlaku untuk jangka waktu 3 (tiga)
tahun dan secara otomatis diperpanjang selama I (satu) tahun berikutnya
secara berturut-turut kecuali dibatalkan secara tertulis oleh Para Pihak 3 (tiga)
bulan sebelum berakhimya Memorandum Saling Pengertian ini;
(3)
Berakhirnya Memorandum Saling Pengertian ini tidak akan mempengaruhi
keabsahan dan j angka waktu pelaksanaan dari program atau kegiatan yang
sedang berjalan yang dibuat sebelum berakhirnya Memorandum Saling
Pengertian ini.
SEBAGAI BUKTI, yang bertandatangan di bawah
Memorandum Saling Pengertian ini.

Dibuat dalam rangkap dua di Jakarta pada tanggal 2 bulan Pebruari tahun 2004 dalam
bahasa Indonesia, Romania dan Inggris, semua naskah mempunyai kekuatan hukum
yang sama. Dalam hal terdapat perbedaan penafsiran mengenai Memorandum Saling
Pengertian in i, naskah bahasa Inggris yang akan berlaku.

I. Oferirea unui cadru de cooperare in domeniile educatiei ｾｩ＠ ｰｲ･ｧｾｴｩ＠
diplomatilor
de nici un caracter comercial;

SFERA DE COOPERARII
Potrivit acestui Mi, sfera de cooperare poate consta in:
I. Schimb de informatii privind curricula cursurilor lor diplomatice, metodele de
pregatire, seminarii, mese rotunde sau alte programe similare cu subiecte de
interes reciproc;
2. Schimb de lectori ｾｩ＠ studenti cu scopul de perfectionare a calificarii lor
reciproca a ｣ｵｮｯｾｴｩ･ｬｲ＠
ｾ ｩ＠ experientei lor;
profesionale ｾｩ＠ pentru ｩｭｰ｡ｲｴｾ･＠
3. Schimb de publicatii ｾｩ＠ alte materiale tiparite de catre Parti sau alte institutii din
tarile lor in domenii privind politica externa, relatii internationale, dreptul
politice precum ｾｩ＠ alte
international, relatii economice international.e, ｾｴｩｮ･＠
subiecte de interes comun;
comune, simpozioane academice, conferinte,
4. Organizare de cercetari ｾ ｴ ｩｮｴｦ｣･＠

Articolul 3
APLICAREA
l. Partile vor organiza consultari periodice, daca se va considera necesar, pentru
aplicarea acestui Ml;
2. Pentru aplicarea acestui MI, Partile vor stabili proceduri, planuri ｾｩ＠
recomandate de cooperare in scopul indeplinirii obiectivelor lor;

SOLUTIONAREA DISPUTELOR

INTRAREA IN VIGOARE, DURATA
ｾｉ＠ INCETAREA VALIDITATII
1. Acest MI va intra In vigoare Ia data semnarii sale;
2. Acest MI va ramane in vigoare pentru o perioada de trei ani, ｾｩ＠ se va prelungi
automat pe perioade consecutive de un an, cu exceptia cazului in care este
denuntat, in scris, de Parti, cu r.el putin trei luni inaintea expirarii acestui MI.
3. incetarea vatidiUitii acestui MY nu va afecta validitatea ｾ ｩ＠ durata programelor sau
activiUitilor aflate In derulare, incheiate anterior lncetarii validitatii acestui MI.

Semnat Ia Jakarta, Ia data de 2 februarie 2004, In doua exemplare originate, In limbile

BETWEEN
THE CENTER FOR EDUCATION AND TRAINING OF THE
DE PARTMENT OF FOREIGN AFFAIRS OF
THE REPUBLIC OF INDONESIA
AND
T HE DIPLOMAT IC ACADEMY OF TH E MINISTRY
OF FOREIGN AFFAIRS OF ROMANIA
ON EDUCAT ION AND TRAINING COOPERATION
The Center for Education and T raining of the Department of Foreign Affairs of the
Republic of Indonesia and the Diplomatic Academy of the Ministry of Foreign
Affairs of Romania hereinafter referred to as " the Parties";
DESIRING to strengthen the existing friendly relations through closer cooperation
in the field of education and training of the Parties;
CONSIDERING the need to develop and foster education and train ing cooperation
as well as cooperation between the education and training institutions of the Parties;
REFERRING to the Agreement of Cultural Cooperation between the Republic of
Indonesia and the Romanian People's Republic signed in Bucharest on 14 April
1960.
PURSUANT to the prevailing laws and regulations of the two countries;
HAVE AGREED AS FOLLOWS:
Article I
OBJECTIVES
The objectives of the Memorandum of Understanding hereinafter referred to as the
"MoU" arc to:
(I)
Provide a framework for cooperation in the field of education and training for
the diplomats of both countries. Such cooperation shall not be guided by any
commercial consideration;
(2)
Create conditions for maintaining regular contacts and cooperation between
the diplomatic institutions of the Parties;
(3)
Promote human resources development for the diplomats of both countries.
Article 2
AREA OF COOPERATION
The area of cooperation under this MoU may consist of:
(I)
Exchange of information on the curricula of their respective diplomatic
courses, methods in training, seminars, workshops, or other simi lar programs
on items of mutual interest;
(2)
Exchange of lecturers and students with a view to upgrading their
professional qualifications and to sharing their respective knowledge and
experience;
(3)
Exchange of publications and other printed materials published by the Parties
or other institutions in their respective countries in the fie ld of foreign policy,
international relations, international law, international economic affairs,
political sciences or other subjects of common interest.
(4)
Organizing joint scientific research, academic symposia, conferences, and
panel discussion on topics of mutual interest as agreed upon by involving the
Parties' experts.
(5)
Conducting programs of basic and specialized courses and mutual
consultations on questions concerning courses in foreign languages.
Article 3
IMPLEMENTATIONS
( I)
The Parties will hold periodical consultations as deemed necessary in
implementing this MoU;
(2)
For the implementation of this MoU, the Parties shall draw up the procedures,
plans and recommended programs of cooperation with a view to achieving its
objectives.
(3)
The financial and administrative arrangements of the above mentioned
programs and other mutually agreed-upon programs made under this MoU
shall be determined by the Parties on a case-by-case basis for their
implementation.
Article 4
SETTLEMENT OF DISPUTE
Any disputes between the Parties concerning the interpretation and/or
implementation of this MoU shall be settled amicably through consultations and
negotiations.
Article 5
AMENDMENT
This MoU can be reviewed or amended at any time by mutual consent by the Parties.
Such revisions or amendments shall enter into force on such date as may be
determined by the Parties and shall form an integral part of this MoU.
Article 6
ENTRY INTO FORCE, DURATION AND TERMINATION
( 1)
This MoU shall enter into force on the date of its signing;
(2)
This MoU shall remain in force for a period of 3 (three) years and
automatically be extended for l (one) year consecutively unless it is
denounced in writing by the Parties at least three (3) months prior to the
expiration ofthis MoU;
(3)
The termination of this MoU shaH not affect the validity and duration of any
ongoing programs or activities made prior to the termmation of this MoU.
IN WITNESS WHEREOF, the undersigned have signed thi5 MoU.
Done in duplicate at Jakarta on the 2"d day of February in the year 2004 in
Indonesian, Romanian, and English languages, all text3 being equally authentic. In
case of any divergence on the interpretation of this MoU, the English text shall
prevail.

Articolul2
SFERA DE COOPERARII
Potrivit acestui Mi, sfera de cooperare poate consta in:
I. Schimb de informatii privind curricula cursurilor lor diplomatice, metodele de
pregatire, seminarii, mese rotunde sau alte programe similare cu subiecte de
interes reciproc;
2. Schimb de lectori ｾｩ＠ studenti cu scopul de perfectionare a calificarii lor
reciproca a ｣ｵｮｯｾｴｩ･ｬｲ＠
ｾ ｩ＠ experientei lor;
profesionale ｾｩ＠ pentru ｩｭｰ｡ｲｴｾ･＠
3. Schimb de publicatii ｾｩ＠ alte materiale tiparite de catre Parti sau alte institutii din
tarile lor in domenii privind politica externa, relatii internationale, dreptul
politice precum ｾｩ＠ alte
international, relatii economice international.e, ｾｴｩｮ･＠
subiecte de interes comun;

Articolul 3
APLICAREA
l. Partile vor organiza consultari periodice, daca se va considera necesar, pentru
aplicarea acestui Ml;
2. Pentru aplicarea acestui MI, Partile vor stabili proceduri, planuri ｾｩ＠
recomandate de cooperare in scopul indeplinirii obiectivelor lor;

3. Aranjamentele financiare ｾｩ＠ administrative ale programelor mentionate mai sus ｾｩ＠
alte programe stabilite de comun acord in baza acestui MY vor fi stabilite de Parti,

INTRAREA IN VIGOARE, DURATA
ｾｉ＠ INCETAREA VALIDITATII
1. Acest MI va intra In vigoare Ia data semnarii sale;
2. Acest MI va ramane in vigoare pentru o perioada de trei ani, ｾｩ＠ se va prelungi
automat pe perioade consecutive de un an, cu exceptia cazului in care este
denuntat, in scris, de Parti, cu r.el putin trei luni inaintea expirarii acestui MI.
3. incetarea vatidiUitii acestui MY nu va afecta validitatea ｾ ｩ＠ durata programelor sau
activiUitilor aflate In derulare, incheiate anterior lncetarii validitatii acestui MI.
Drept pentru care, subsemnati i Reprezentan!i, au semnat prezentul

Semnat Ia Jakarta, Ia data de 2 februarie 2004, In doua exemplare originate, In limbile

BETWEEN
THE CENTER FOR EDUCATION AND TRAINING OF THE
DE PARTMENT OF FOREIGN AFFAIRS OF
THE REPUBLIC OF INDONESIA
AND
T HE DIPLOMAT IC ACADEMY OF TH E MINISTRY
OF FOREIGN AFFAIRS OF ROMANIA
ON EDUCAT ION AND TRAINING COOPERATION
The Center for Education and T raining of the Department of Foreign Affairs of the
Republic of Indonesia and the Diplomatic Academy of the Ministry of Foreign
Affairs of Romania hereinafter referred to as " the Parties";
DESIRING to strengthen the existing friendly relations through closer cooperation
in the field of education and training of the Parties;
CONSIDERING the need to develop and foster education and train ing cooperation
as well as cooperation between the education and training institutions of the Parties;
REFERRING to the Agreement of Cultural Cooperation between the Republic of
Indonesia and the Romanian People's Republic signed in Bucharest on 14 April
1960.
PURSUANT to the prevailing laws and regulations of the two countries;
HAVE AGREED AS FOLLOWS:
Article I
OBJECTIVES
The objectives of the Memorandum of Understanding hereinafter referred to as the
"MoU" arc to:
(I)
Provide a framework for cooperation in the field of education and training for
the diplomats of both countries. Such cooperation shall not be guided by any
commercial consideration;
(2)
Create conditions for maintaining regular contacts and cooperation between
the diplomatic institutions of the Parties;
(3)
Promote human resources development for the diplomats of both countries.
Article 2
AREA OF COOPERATION
The area of cooperation under this MoU may consist of:
(I)
Exchange of information on the curricula of their respective diplomatic
courses, methods in training, seminars, workshops, or other simi lar programs
on items of mutual interest;
(2)
Exchange of lecturers and students with a view to upgrading their
professional qualifications and to sharing their respective knowledge and
experience;
(3)
Exchange of publications and other printed materials published by the Parties
or other institutions in their respective countries in the fie ld of foreign policy,
international relations, international law, international economic affairs,
political sciences or other subjects of common interest.
(4)
Organizing joint scientific research, academic symposia, conferences, and
panel discussion on topics of mutual interest as agreed upon by involving the
Parties' experts.
(5)
Conducting programs of basic and specialized courses and mutual
consultations on questions concerning courses in foreign languages.
Article 3
IMPLEMENTATIONS
( I)
The Parties will hold periodical consultations as deemed necessary in
implementing this MoU;
(2)
For the implementation of this MoU, the Parties shall draw up the procedures,
plans and recommended programs of cooperation with a view to achieving its
objectives.
(3)
The financial and administrative arrangements of the above mentioned
programs and other mutually agreed-upon programs made under this MoU
shall be determined by the Parties on a case-by-case basis for their
implementation.
Article 4
SETTLEMENT OF DISPUTE
Any disputes between the Parties concerning the interpretation and/or
implementation of this MoU shall be settled amicably through consultations and
negotiations.
Article 5
AMENDMENT
This MoU can be reviewed or amended at any time by mutual consent by the Parties.
Such revisions or amendments shall enter into force on such date as may be
determined by the Parties and shall form an integral part of this MoU.
Article 6
ENTRY INTO FORCE, DURATION AND TERMINATION
( 1)
This MoU shall enter into force on the date of its signing;
(2)
This MoU shall remain in force for a period of 3 (three) years and
automatically be extended for l (one) year consecutively unless it is
denounced in writing by the Parties at least three (3) months prior to the
expiration ofthis MoU;
(3)
The termination of this MoU shaH not affect the validity and duration of any
ongoing programs or activities made prior to the termmation of this MoU.
IN WITNESS WHEREOF, the undersigned have signed thi5 MoU.
Done in duplicate at Jakarta on the 2"d day of February in the year 2004 in
Indonesian, Romanian, and English languages, all text3 being equally authentic. In
case of any divergence on the interpretation of this MoU, the English text shall
prevail.
