TENTAN G KERJASAMA BILATERAL PADA KOMODITAS
Pemerintah Republik Indonesia dan Pemerintah Malaysia (selanjutnya disebut
tunggal sebagai "Pihak" dan secara kolektif sebagai "Para Pihak").
MENGINGAT Nota Kesepahaman antara Pemerintah Republik Indonesia dan
Pemerintah Malaysia pada Kerjasama Bilateral pada Komoditas ditandatangani di
Putrajaya, Malaysia pada hari 25 Mei pada tahun 2006 oleh Para Pih::Ik
(selanjutnya disebut sebagai "MoU" ).
MENEGASKAN niat Para Pihak untuk mengubah MoU untuk Kerjasama Jatropa
dalam Pertemuan bilateral dengan Forum Komite Bersama (JCM) ke-5 bidang
Komoditas yang diselenggarakan pad a tang gal 6 Mei 2010 di Yogyakarta,
Republik Indonesia.
MENCATAT bahwa berdasarkan Pasal XII MoU menetapkan bahwa salah satu
Pihak dapat meminta secara tertulis revisi, modifikasi atau perubahan dari semua
atau sebagian dari MoU. Setiap revisi, modifikasi atau amandemen harus disetujui
oleh para Pihak dan tidak akan merugikan hak-hak dan kewajiban yang
ditimbulkan dari atau berdasarkan MoU sebelumnya atau sampai dengan tanggal
revisi, modifikasi atau perubahan disepakati para Pihak.
TELAH MENCAPAI pemahaman dan menyetujui sebagai berikut:
PASAL1
Pasal 1 MoU harus diubah untuk mencakup jarak dalam definisi komoditas
sebagai berikut:
"PASAL 1

lstilah "komoditas" dalam Nota Kesepahaman ini berarti kelapa sawit, lada, kakao,
jarak pagar dan produk-produk mereka."
PASAL 2
Protokol ini harus merupakan bagian integral dari MoU.
PASAL3
Protokol ini akan mulai berlaku pada tanggal penandatanganan perjanjian
terse but.
DENGAN KESAKSIAN yang bertandatangan di bawah ini, yang telah diberi kuasa
yang sah oleh masing-masing Pemerintah, telah menandatangani Protokol ini.
DIBUAT dalam rangkap dua di Lombok, Indonesia tanggal 20 Oktober tahun 2011
dalam Bahasa Indonesia, dan Bahasa lnggris, dimana kedua naskah tersebut
merupakan naskah asli. Dalam hal terjadi perbedaan penafsiran dan penerapan
dari Protokol ini teks dalam Bahasa lnggris yang akan digunakan.

PROTOCOL TO AMEND
TH E MEMORANDUM OF UNDERSTANDING
BETWEEN
THE GOVE RNMENT OF THE REPUBLIC OF INDO NESIA
AND
THE GOVERNMENT OF MALAYSIA
ON BI LATERAL COOPERATIO N ON COMMODITIES
The Government of the Republic of Indonesia and the Government of Malaysia
(hereinafter referred to singularly as "the Party" and collectively as "the
Parties") .
RECALLING the Memorandum of Understanding between the Government of
the Republic of Indonesia and the Government of Malaysia on Bilateral
Cooperation on Commodities signed at Putrajaya, Malaysia on the 25th day of
May in the year 2006 by the Parties (hereinafter referred to as "the MoU").
CONFIRMING the intention of the Parties to amend the MoU for cooperation in
Jathropa during the Fifth Joint Committee Meef:ing on Bilateral Cooperation on
Commodities which was held on the 6th day of May 2010 at Yogyakarta,
Republic of Indonesia.
NOTING that under Article XII of the MoU provides that either Party may
request in writing a revision, modification or amendment of all or any part of the
MoU where any revision, modification or amendment agreed by the Parties
shall be reduced into writing and shall form part of the MoU and such revision,
modification or amendment shall not prejudice the rights and obligations arising
from or based on the MoU prior or up to the date of such revision, modification
or amendment.
HAVE REACHED an understanding and agreed as follows :

ARTICLE I
Article I of the MoU shall be amended to include Jatropha in the definition of
commodities as follows:
"ARTICLE 1
DEFINITION
The term "commodities" in this Memorandum of Understanding shall mean palm
oii, papper, cocoa , Jatropha and their products."
ARTICLE 2
This Protocol shall form an integral part of the MoU.
ARTICLE 3
This Protocol shall enter into force on the date of its signing .
IN WITNESS WHEREOF the undersigned, being duly authorized thereto, have
signed this Protocol.
DONE in duplicate, at Lombok, Indonesia on this 201h day of October in the year
Two Thousand and Eleven, each in the Indonesian and English Language, all
texts being equally authentic. In case of any divergence of interpretation of this
Memorandum of Understanding, the English text shall prevail.
