BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA
AND
THE GOVERNMENT OF THE REPUBLIC OF FRANCE
RELATING TO
PROGRAM
AID
The Government of the Republic of Indonesia and the
Government of the Republic of France , with view to facilitate the
objectives and the policies designed by Indonesia in order to cope
with its present and temporary difficulties and to achieve its
economic development, agreed on the following provisions:
ARTlCLE I
-A loan amounting to a maxi mum of 150 Mjllion FrPnrh Fr nr ..
is provided by the Government of the Republic of France to 1.hP
Government of the Republic of Indonesia for program aid.
ARTICLE l i
This loan may be utilized by public and private entities
as well as franco-indonesian joint ventures,
for the financing of
urgently needed imports of goods and services of French origin,
with the exception of raw materials,
consumption goods,
military
and publi c security equipment,
and in line with the attached list
of items.
ARTICLE III
The loan shall be amortized in 40 half-yearly equal and
successive instalments,
the first one falling due 66 months after
the end of the calendar half year during which the first drawing
has been made.
The interest shall be payable every calendar half year at
a rate of 5,5% per annum.
Besides,
usual rules will apply to COFACE premium
portion not financed by the French Treasury funds .

behalf on one part,
and the Ministry of Finance of the Government
of Indonesia on the other part, shall specify the modaljt ies of use
and repayment of this loan.
ARTICLE IV
The currency used for accounting and payment shall be
French franc.

Commercial contracts to be financed through the present
loan shall be invoiced at F . O .B . prices. Nevertheless the financing
of freight and insurance premiums may be covered under this
protocol when:

- the transportation is undertaken under a bill of lading issued by
ｆｲｾｮ｣ｨ＠
shipowner and supported by a certification issued by the
ｾｲ ｐ ｮ ｲ ｨ＠ Hnarct of merchant marine:
- the insurance is contracted with a French company.
ARTICLE VI
The minimum amount for each individual c ontrac t

protocol after June 30th, 1989.

L'AIDE PROGRAMME
Le
Gouvernement
de la Republique d'Indonesie
et
le
Gouvernement
de la Republique fran9aise sont
convenus
des
dispositions
suivantes afin de faciliter la realisation des
objectifs et la mise en oeuvre des politiques decidees par
l'Indonesie pour surmonter les difficultes temporaires auxquelles
elle est actuellement confrontee et pour mener a bien
son
developpement economique.
ARTICLE I
Un pret s'elevant au maximum a CENT CINQUANTE MILLIONS
DE FRANCS FRANCAIS (150 MF) est consenti par le Gouvernement de la
Republique fran9aise au Gouvernement de la Republique d'Indonesie,
a titre d'aide programme.
ARTICLE II
Ce pret est accessible aux organismes publics et prives,
ainsi qu'aux entreprises conjointes franco-indonesiennes,
pour
financer des besoins d'importations interessant ､ｾｳ＠
biens et
services d'origine fran9aise, a l'exception des matieres premieres,
des produits de consommation, des equipements a vocation militaire
OU
de securite publique,
et conformement a la liste de produits
annexee .
ARTICLE III
Le pret est amortissable en quarante
(40)
semestrialites
egales et successives,
la premiere venant a echeance soixante-six
(66) mois apres la fin du semestre civil au cours duquel aura ete
effectue le premier tirage.
Les interets sont payables semestriellement au taux annuel de
5,5%.
Par ailleurs,
les regles habituelles en matiere de primes
COFACE sont applicables a la partie du pret non f inancee par des
fonds du Tresor.
Les modalites d'utilisation et de remboursement du pret
seront
precisees par une convention d'application entre les
institutions financieres designees par le Gouvernement fran9ais et
agissant pour son compte, d'une part, et le Ministere des Finances
du Gouvernement de l'Indonesie, de l'autre.
ARTICLE IV
Le franc fran9ais est la monnaie de compte et de paiement.
ARTICLE V
Les contrats finances au titre du present pret sont factures
au prix F.A.B. Toutefois, le financement du fret et de !'assurance
peut etre couvert par le pret lorsque :
- Le transport est eff ectue sous connaissement emis par un
armateur francais et benificie d'une certification delivree par un
service de la Marine marchande francaise;
- Les

Un acompte representant au minimum 10% de la valeur F.A.B. du
contrat est payable a la commande.
Le solde du prix est reglable conformement

Le Fonds general du Tresor gere par le Ministere des Finances

accord, en vue d'assurer le financement des parts locales des

Le Ministere des Finances notifie a l'Ambassade de France
