ABSTRAK
Pengawasan yang dilakukan oleh pemerintah dan perlindungan
yang diberikan oleh pengusaha merupakan kewajiban dan tanggung
jawab yang harus dilakukan oleh pengusaha dan pemerintah guna
melindungi keselamatan dan kesehatan para pekerja wanita selama
bekerja dan telah diatur melalui berbagai macam peraturan perundangundangan, namun pada praktiknya sering terjadi permasalahan yang
berkaitan dengan pengawasan pemerintah. Adapun tujuan dari penelitian
ini untuk mengetahui tata cara pemberian perlindungan oleh pengusaha
dan pengawasan pemerintah dalam menjamin terpenuhinya hak-hak
pekerja wanita.
Metode Pendekatan yang digunakan bersifat yuridis normatif, yaitu
suatu metode pendekatan yang menitik beratkan penelitian kepada data
kepustakaan dan data sekunder yang berupa bahan hukum primer,
sekunder, dan tersier baik berupa peraturan perundang-undangan,
literatur hukum, serta bahan-bahan lain yang mempunyai hubungan di

dalam penulisan skripsi ini, dengan spesifikasi penelitian deskripsi analitis
dan metode analitis data secara yuridis normatif kualitatif tanpa
menggunakan rumus-rumus matematika dan data-data statistik.
Hasil Penelitian terhadap Pengawasan Pemerintah Terhadap
Perlindungan Pekerja Wanita jika dihubungkan dengan UU No. 39 Tahun
1999 Tentang Hak Asasi Manusia dan UU No. 13 Tahun 2003 Tentang
Ketenagakerjaan tidak berjalan dan tidak sesuai dengan peraturan
perundangan-undangan yang berlaku dalam pelaksanaan pengawasan
oleh pegawai pengawas, sehingga masih terdapat perusahaanperusahaan yang sampai saat ini tidak menjalankan kewajibannya untuk
memberikan perlindungan terhadap pekerja wanita yang bekerja
diperusahannya.

ABSTRACT

Controlling by government and protection which is given by
employers are an obligation and responsibilities which must be done by
government and employers to protect the safety and health of women
workers as long as they work in the office and it has arranged by some
regulations in Indonesia. But in reality, there are still have a lot of problem
about government control and protection of women workers. The aim of
this research is to understand and determine about procedure in giving the
protection by employers and controlling by government to guarantee the
rights of women workers.
The approach method used in this research is normative juridical,
an approach which emphasizes the study in literature and secondary data
which are primary, secondary and tertiary laws such as regulations, law
literatures and other materials related to the scope of this study with the
specification of analytical descriptive study.
The result of this research shows that controlling by government
and protection which is given by employers are still not appropriate with
the applicable regulations, especially, regulations about human rights and
employment. So, it makes some employers do not fulfill their obligation to
protect the women workers which are works in their office.
