AUSTRALIA

Direktorat Jenderal Hak Kekayaan lntelektual (DJHKI) dan IP Australia dalam
hal ini disebut sebagai "Para Pihak";

MENYADARI perlunya usaha untuk mempromosikan dan memperkuat sistem
HKI dengan maksud memberikan respon yang efektif terhadap tantangan
global;

BERMAKSUD untuk mengernbang lebih lanjut kerja sama antara IP Australia

dan DJHKI dalam rangka mempromosikan pengembangan sistem HKI dan;

MEMPERTIMBANGKAN dimensi pengembangan HKI;

Telah menyepakati hal-hal sebagai berikut:

ARTIKEL 1: TUJUAN

untuk

membentuk


mekanisme dan partisipasi dalam program Pelatihan Pemeriksaan Paten
Regional IP Australia

(IP Australia's Regional Patent Examination Training

(RPET) program).

ARTIKEL 2: SASARAN
Program RPET bertujuan untuk membangun/mengembangkan kemampuan
pemeriksaan paten negara peserta dengan meningkatkan kompetensi para
pemeriksa dalam melaksanakan penelusuran dan pemeriksaan sesuai dengan
standar Patent Cooperation Treaty (PCT), menerapkan hasil pembelajaran
tersebut di tempat mereka bekerja, dan memfasilitasi para peserta dengan
kemampuan untuk menyesuaikan praktek pemeriksaan dan penelusuran
domestik dengan standar internasional. Hal ini diharapkan dapat memberikan
kontribusi terhadap pemberian hak paten yang konsisten dan dan berkualitas
dan peningkatan kepercayaan bisnis dalam sistem HKI.

ARTIKEL 3: RUANG LINGKUP


Program RPET menfasilitasi pelatihan pemeriksaan paten yang intensif,
komprehensif dan kompetensi pelatihan HKI berbasis online. Kurikulum,
konten/materi dan Penilaian RPET mengacu pada pelatihan pemeriksaan dan
standar kualitas yang digunakan di IP Australia. Sebagai program yang
berbasis kompetensi, peserta pelatihan akan dinilai secara progresif dalam
beberapa keahlian dan praktek yang digunakan dalam standar internasional.
Untuk memperoleh kompetensi tersebut, peserta program pelatihan ini perlu
secara konsisten menerapkan keahlian dan pengetahuan tersebut di tempat
mereka bekerja. Tercapainya kompetensi juga akan menfasilitasi pemeriksa
paten dengan keahlian yang diperlukan dalam pemeriksaan aplikasi paten
secara independen, konsisten dan sesuai dengan standar internasional.

Setiap peserta pelatihan akan didampingi oleh satu pemeriksa paten Australia
yang berpengalaman selama berlangsungnya program RPET. Hal ini meliputi
pengajaran (mentoring) satu per satu, on-the-job training dan penilaian yang
berkelanjutan terhadap perkembangan para peserta pelatihan. Selain itu, para
peserta juga akan didampingi oleh seorang pendamping lokal yang berfungsi

sebagai

mentor/pengajar

yang

diwakili/disiapkan

oleh

DJHKI

selama

berlangsung program dimaksud . Untuk menyelesaikan program ini diperlukan
waktu dua (2) tahun dan akan bergantung pada kemampuan peserta untuk
meningkatkan diri dan memperoleh kompetensi yang diperlukan .

ARTIKEL 4: TANGGUNG JAWAB/KEWAJIBAN
IP Australia akan:

i.

Menyiapkan maksimal empat (4) orang pemeriksa paten IP Australia
yang berpengalaman untuk bekerja dengan waktu penuh sebagai pelatih
program . Peserta dari DJHKI

jika dimungkinkan akan bekerja sama

dengan pelatih yang sama dari IP Australia selama berlangsungnya
program dimaksud.
ii .

Tetap mempertahankan sumber daya dan perangkat pembelajaran yang
sesuai yang dapat diakses jarak jauh oleh peserta dari DJHKI. Hal ini
akan memberikan fleksibilitas kepada peserta dari DJHKI

untuk

menyelesaikan program dimaksud sesuai dengan kemampuannya dan
pada


waktu

yang

sama

tetap

dapat

menyelesaikan

pekerjaan

pemeriksaan paten di tempat mereka bekerja.
iii.

Bertanggung jawab terhadap pengelolaan/pengurusan semua perincian
program .


Hal

DJHKI akan:

Mengusulkan para peserta untuk program RPET dengan kualifikasi
sebagai berikut:

Memiliki pengalaman minimal dua (2) tahun dalam penelusuran dan
pemeriksaan paten dan


telah melaksanakan penelusuran dan

pemeriksaan substabtif di DJHKI.


Menunjukkan komitmen untuk berbagi pengetahuan yang diperoleh
dari program pelatihan dengan para pemeriksa paten lainya di
DJHKI. Diharapkan peserta dimaksud memiliki peran pelatihan atau
berpotensi untuk memiliki peran pelatihan di masa yang akan
datang.



Menunjukkan komitmen untuk meraih kompetensi/menyelesaikan
program sesegera mungkin, maksimal dalam waktu dua (2) tahun ..



Memiliki gelar sarjana di bidang teknologi , atau diploma dengan
pengalaman di bidang industri yang sesuai , yang relevan dengan

spesialisasi pemeriksaan peserta.



Mampu menggunakan bahasa inggris dengan lancar (lisan dan
tulisan) dan memiliki keahlian komputer yang baik, termasuk
kemampuan untuk menggunakan internet secara mandiri, word

processing and paket-paket surat elektronik/emai/.


Bersedia mengikuti sesi kelas virtual yang telah dijadwalkan selama
berlangsungnya program dan memiliki kapasitas/kemampuan untuk
mengikuti kursus/course work meskipun melaksanakan tugas-tugas
pemeriksaan sesuai yang ditentukan oleh DJHKI.

ii .

Mengusulkan seorang pendamping lokal untuk setiap peserta pelatihan
DJHKI. Pendamping lokal tersebut harus

bekerja sama dengan para pelatih IP Australia untuk memonitor dan
menilai kemajuan para peserta pelatihan.

Hal ini sewaktu-waktu

juga memerlukan partisipasi dalam beberapa kegiatan online yang
sudah dijadwalkan dan sesi kelas virtual.


Memiliki kemampuan untuk melatih peserta secara reguler dan
menelaah penilaian tugas dan rencana pembelajaran peserta.



Mampu menggunakan bahasa inggris dengan lancar (lisan dan
tulisan) dan memiliki keahlian komputer yang baik, termasuk
kemampuan untuk menggunakan internet secara mandiri , word
processing and paket-paket surat elektronik ..



Memfasilitasi pelatihan yang berkaitan dengan perundang-undangan
di negara bersangkutan bagi para peserta, jika diperlukan, sehingga
para peserta dapat mengaplikasikan materi yang telah dipelajari
selama mengikuti program RPET secara langsung di tempat mereka
bekerja yang ditujukan untuk peningkatan kemampuan pemeriksaan
sesuai dengan standar internasional..

iii .

Memberikan

dukungan

kepada

peserta

pelatihan

DJHKI

dan

pendamping lokal selama berlangsungnya program sehingga para
peserta dan pendamping lokal tersebut dapat memperoleh manfaat yang
maksimal dari program RPET ini.
iv.

Berusaha untuk mendorong para peserta DJHKI untuk tetap mengikuti
program sampai selesai. Sehingga DJHKI dapat memperoleh manfaat
yang maksimal dari program RPET (untuk jangka panjang

dapat

memperoleh kualitas paten yang semakin baik secara kolektif di wilayah
tersebut), perlu dipertimbangkan oleh DJHKI untuk mempromosikan
peserta yang mampu bertahan dan sukses menyelesaikan program .
v.

Menyediakan infrastruktur teknis yang memadai guna memfasilitasi
partisipasi dalam program pelatihan. Dengan persyaratan minimal teknis
sebagai berikut:

ARTIKEL 5: JAMINAN KEAMANAN

Sebagian besar Program RPET akan dilakukan secara online melalui Virtual
Learning Environment (VLE) dan memerlukan user name dan password untuk

verifikasi. Untuk menjamin keamanan dan otentisitas program, DJHKI perlu
memastikan bahwa orang yang mengakses RPET VLE adalah user/pengguna
yang resmi dan sistem yang digunakan adalah yang biasa dipakai untuk tujuan
pelatihan dan kerja sama .

ARTIKEL 6: KERAHASIAAN
Jika tidak bertentangan dengan perundang-undangan, peraturan dan kebijakan
administrasi yang berlaku di wilayah hukum/yurisdiksi para pihak, para pihak
akan melakukan pengamatan/penelitian terhadap dokumen dan informasi
rahasia dan data lain yang diterima atau yang disediakan para pihak selama
periode pemberlakuan Memorandum Saling Pengertian

ini atau persetujuan

lain yang dibuat sesuai dengan Memorandum Saling Pengertian ini. ..lika salah
satu pihak berkeinginan untuk menyampaikan informasi rahasia pada pihak
ketiga yang merupakan hasil dari kegiatan kerja sama menurut Memorandum
Saling Pengertian ini, pihak yang akan menyampaikan tersebut harus
memperoleh izin dari pihak lain sebelum diungkapkan.

Dalam Memorandum Saling Pengertian ini, lnformasi rahasia dijelaskan dalam
item 1 yang terdapat dalam lampiran.

Ketentuan dalam paragraf ini akan tetap berlaku terhadap para pihak meskipun
Memorandum Saling Pengertian ini telah dihentikan.

ARTIKEL 7: BIAYA

Program RPET ini didanai oleh /P Australia dan

ASEAN-Australia-New

Zealand FTA (AANZFTA) Economic Cooperation Work Program.

Program

RPET akan menanggung biaya perjalanan termasuk pesawat, akomodasi dan
biaya hidup/uang saku untuk partisipasi dalam satu (1) tatap muka workshop
intensif pendamping lokal dan satu (1) tatap muka workshop pelatihan untuk
pendamping lokal DJHKI dan peserta pelatihan masing-masing di Canberra,
Australia . Para pihak akan menanggung biaya-biaya lain yang berkaitan
dengan pegawai masing-masing yang muncul dari kegiatan-kegiatan yang
dihasilkan dari Memorandum Saling Pengertian ini.

ARTIKEL 8: STATUS STAF KHUSUS

Staf yang ditugaskan oleh para pihak dalam kegiatan-kegiatan yang berkaitan
dengan Memorandum Saling Pengertian ini tetap dalam arahan dan wewenang
institusi mereka, tanpa adanya hubungan kerja baru. Baik DJHKI maupun IP
Australia tidak dapat dianggap sebagai pemberi kerja pengganti.

ARTIKEL 9: AMANDEMEN

Memorandum Saling Pengertian dapat diamandemen melalui izin tertulis
bersama dari kedua belah pihak dengan saling mengirim surat, yang
menetapkan tanggal berlakunya amandemen dimaksud.

ARTIKEL 10: KEPEMILIKAN DAN PENGADAAN BARANG

Kekayaan intelektual dan kepemilikan :

a.

Materi yang dibuat oleh by IP Australia untuk kepentingan RPET dan MOU
ini;

b. Materi yang disediakan atau perlu disediakan oleh IP Australia sebagai
bagian dari RPET atau MOU ini;
c.

Peralatan yang diadakan oleh IP Australia dari pembiayaan MNZFTA
untuk terwujudnya partisipasi DJHKI dalam RPET;

d.

Materi yang berasal dari materi atau peralatan yang dimaksud dalam
paragraf a, b dan c;

Akan diserahkan kepada IP Australia .
Perangkat keras, perangkat lunak berlisensi atau peralatan yang dibeli untuk
DJHKI oleh IP Australia, biaya yang digunakan untuk partisipasi dalam RPET,
salinan bahan pelatihan yang disediakan oleh IP Australia, akan menjadi milik
DJHKI. Biaya lisensi yang sedang berjalan dan pemeliharaan yang digunakan
dan bantuan untuk perangkat lunak, peralatan dan perangkat keras akan
menjadi tanggung jawab DJHKI.

ARTIKEL 11: PENYELESAIAN SENGKETA

Para pihak akan berusaha menyelesaikan setiap sengketa yang muncul
berkaitan

dengan

interpretasi

atau

implementasi

Memorandum

Saling

Pengertian ini melalui konsultasi dan cara damai . Jika ternyata usaha tersebut
menemui kegagalan, salah satu pihak dapat mengakhiri Memorandum Saling
Pengertian ini tanpa adanya waktu pemberitahuan dan tanpa adanya
pertentangan dengan kemungkinan penerapan paragraf terakhir Bagian 12.

ARTIKEL 12 JANGKA WAKTU DAN PENGAKHIRAN

Memorandum Saling Pengertian ini akan mulai berlaku terhitung sejak tanggal
ditandatanganinya Memorandum Saling Pengertian ini oleh kedua belah pihak
dan tetap berlaku sampai salah satu pihak mengakhiri Memorandum Saling
Pengertian ini.

Salah satu pihak dapat mengakhiri Memorandum Saling Pengertian ini
sewaktu-waktu dengan didahului pemberitahuan tertulis paling kurang 90
(Sembilan puluh) hari kalender.

Jika Memorandum Saling Pengertian ini dihentikan/berakhir di tengah jalan,
para pihak secara bersama sepakat untuk melanjutkan kegiatan pelatihan yang
sudah dimulai dalam program RPET ini. Untuk hal ini , para pihak harus saling

menyetujui perinciannya secara tertulis. Kelanjutan dari kegiatan-kegiatan
dimaksud tidak dapat diperkirakan .

DENGAN DISAKSIKAN KEDUA BELAH PIHAK, yang bertanda tangan di

bawah, menandatangani Memorandum Saling Pengertian ini.

Ditandatangani rangkap dua dalam bahasa lnggris dan Indonesia, kedua teks
tersebut bersifat otentik.

Jika terjadi

perbedaan

penafsiran

mengenai

Memorandum Saling Pengertian ini , maka yang berlaku adalah teks bahasa
lnggris.

MEMORANDUM OF UNDERSTANDING (MOU)
BETWEEN
IP AUSTRALIA
AND
DIRECTORATE GENERAL OF INTELLECTUAL PROPERTY RIGHTS
CONCERNING IP AUSTRALIA'S
REGIONAL PATENT EXAMINATION TRAINING PROGRAM

The Directorate General of Intellectual Property Rights (DGIPR) and IP
Australia hereinafter referred to as "the Participants",

RECOGNISING the need to promote and strengthen intellectual property (IP)
systems with a view to providing effective responses to global challenges;

DESIRING to further develop cooperation between IP Australia and DGIPR in
order to promote the further development of IP systems; and

TAKING into consideration the development dimension of IP;

have reached the following understandings:

1.

PURPOSE

This MOU establishes the mechanism for and participation in IP Australia's
Regional Patent Examination Training (RPET) program.

2.

OBJECTIVES

The RPET program aims to build the patent examination capabilities of
participating offices by improving the competency of examiners to conduct
search and examination to Patent Cooperation Treaty (PCT) standards,
embedding the learning into the workplace, and providing offices the ability to
align domestic practices with international standards . This will contribute to the
granting of higher quality, consistent patent rights and increased business
confidence in the IP system .

3.

SCOPE

The RPET program provides intensive, comprehensive and competency-based
online patent examination training.

The RPET curriculum , content and

assessment are based on IP Australia's existing examination training and
quality framework.

As a competency-based program, trainees will be

progressively assessed against defined skill sets and international standards of
practice.

To be a 'competent' graduate of the program, trainees need to

consistently demonstrate the application of their skills and knowledge to their
own work.

Each trainee will be supported by an experienced Australian patent examiner
throughout the RPET program. This includes one-on-one mentoring, on-the-job
training and continuous assessment of the trainee's progress. Trainees must
also be supported by a local supervisor in the role of mentor, allocated by
DGIPR, for the duration of the program. Completion of the program may take
up to two years and will depend on the trainee's ability to progress and attain
the required competencies.

4.

RESPONSIBILITIES

IP Australia will :
1.

Allocate up to four experienced IP Australia examiners to work full-time
as program trainers.

DGIPR trainees will work where possible with the

same IP Australia trainer for the duration of the program.
ii.

Continue to maintain appropriate learning resources and tools that can be
accessed remotely by trainees from DGIPR.

This will give DGIPR

trainees flexibility to complete the program at their own pace and at the
same time as doing their local examination work.
iii.

Be responsible for the management of all program details. This includes:
content development and maintenance, scheduling of training activities,
and hosting up to two face-to-face intensive courses in Canberra,
Australia.

DGIPR will :
i.

Nominate trainees for the RPET program that meet the following eligibility
criteria:


Have a minimum of two (2) years' experience in patent search and
examination

and

currently

conduct

substantive

search

and

examination in DGIPR.


Demonstrate a commitment to share knowledge gained from the
program with other examiners in DGIPR. Preferably, they will have a
current training role or are likely to have a training role in the future.



Demonstrate commitment to attain competency as quickly as
possible, within a maximum of two years.



Hold a degree in an area of technology, or a diploma together with
appropriate industry experience, that is relevant to the trainee's
examination specialisation.



Be fluent in English (both written and spoken) and possess sound
computer skills, including the ability to independently use the
Internet, word processing and email packages.

Be available to attend scheduled virtual classroom sessions
throughout the program and have the capacity to undertake course
work whilst still conducting examination tasks as specified by DGIPR.

Nominate a local supervisor for each DGIPR trainee.

The local

supervisor is to meet the following eligibility criteria:


Have a minimum experience of five (5) years in substantive search
and examination, and a direct role in examiner training and/or
continuous improvement in DGIPR.



Preferably, have the capability to examine within the same
technology field as the trainee.



Demonstrate commitment to actively participate in the RPET
Community of Practice and work with IP Australia trainers to monitor
and assess trainee progress.

This will require , on occasion,

participation in scheduled online activities and virtual classroom
sessions.


Have capacity to regularly mentor the trainee and review the
trainee's assessment tasks and learning plan.



Be fluent in English (both written and spoken) and possess sound
computer skills, including the ability to independently use the
Internet, word processing and email packages.



Facilitate training on domestic legislation to trainees, as required, so
they can apply what they learn during the RPET program directly to
their domestic work where enhancing examination capability to
international standards is the aim.

iii.

Support DGIPR trainees and local supervisors throughout the program so
that they, and DGIPR, get the maximum benefit from the RPET program.

iv.

Endeavour to retain DGIPR trainees following their completion of the
program .

So that DGIPR receives maximum benefit from the RPET

program (and in the long term to collectively achieve improved patent
quality in the region), it would be useful to consider options within DGIPR
that promote the retention of trainees who successfully complete the
program.

v.

Provide appropriate technical infrastructure to facilitate participation in the
program . Minimum technical requirements are as follows:

SECURITY

The RPET program will be delivered predominantly online via a Virtual Learning
Environment (VLE) and require user name and password identify verification.
To ensure the security and authenticity of the program , DGIPR will need to
ensure that individuals accessing the RPET VLE are authorised users and the
systems are being used for the intended purpose of training and collaboration.
6.

CONFIDENTIALITY

Without any prejudice to the laws, regulations and administrative policies that
have effect in each of the Participants' jurisdictions, the Participants will
undertake to observe the confidentiality of documents, information and other
data received or supplied between the Participants during the period of the
implementation of this MOU or any other agreements made pursuant to this
MOU. If one of the Participants wishes to transmit to a third party Confidential
Information

resulting

from

cooperative

activities

under this

MOU , the

transmitting Participant must obtain prior consent from the other Participant
prior to any disclosure.

In this MOU , Confidential Information is defined in item 1 of the Schedule.

The provision of this paragraph will remain in effect between the participants
notwithstanding the termination of this MOU.
7.

FUNDING

The RPET program is funded by IP Australia and by the ASEAN-Australia-New
Zealand FTA (AANZFTA) Economic Cooperation Work Program. The RPET
program will finance travel costs including flights, accommodation and a daily
subsistence allowance for participation in one (1) face to face local supervisor
intensive workshop and one ( 1) face to face intensive training workshop for
DGIPR local supervisors and trainees respectively in Canberra, Australia . The
Participants will be responsible for any other expenses of their respective
employees incurred from the activities resulting from this MOU.

8.

STATUS OF DEDICATED STAFF

Staff assigned by the Participants to the activities related to this MOU will
remain under the direction and authority of the institution to which they belong,
without any new employment relationship being created . Neither DGIPR nor IP
Australia may be considered as a substitute employer.

9.

AMENDMENT

This MOU may be amended with the written mutual consent of both Participants
by an exchange of letters, specifying the commencement date of the
amendments.

10.

OWNERSHIPAND PROCUREMENT

Intellectual Property in and ownership of any:
a. material created by I P Australia for the purposes of the RPET and this
MOU ;

b. material provided or required to be provided by IP Australia as part of the
RPET or this MOU;
c. equipment procured by IP Australia from the AANZFTA funds to enable
participation of DGIPR in the RPET;
d.

material derived at any time from the material or equipment referred to in
paragraphs a, band c;

will vest in IP Australia.

Any hardware, licensed software or equipment purchased for DGIPR by IP
Australia, funds to enable participation in the RPET, as well as hard copies of
training materials provided by IP Australia , will be owned by DGIPR once
received by it. The ongoing licence fees and any applicable maintenance and
support for the software, equipment and hardware will be the responsibility of
DGIPR.
11.

SETTLEMENT OF DISPUTES

The Participants will endeavour to settle any dispute that may arise in
connection with the interpretation or implementation of this MOU by amicable
consultations. Should the latter fail, either participant may terminate the MOU
without notice period and without prejudice to the possible application of the last
paragraph of Section 12

This MOU will come into effect on the date of signing by both Participants and
will continue to have effect until either or both of the Participants terminate this
MOU.

Either Participant may terminate this MOU at any time by giving at least 90

to continue training activities already initiated under the RPET program . For
this purpose the Participants have to mutually consent to the details in writing.
Such continuation of activities cannot be presumed or implied.

REGIONAL PATENT EXAMINAT10N TRAINING PROGRAM

The Directorate General of Intellectual Property Rights (DGIPR) and IP Australia
hereinafter referred to as "the Participants",
RECOGNISING the need to promote and strengthen intellectual property OP)
systems with a view to providing effective responses to global challenges;
DESIRING to further develop cooperation between IP Australia and DGIPR in order
to promote the further development of IP systems; and
TAKING into consideration the devel'o pment dimension of IP;

have reached the following understandings:

PURPOSE

This MOU establishes the mechanism for and participation in IP Australia's Regional
Patent Examination Training (RPET) program.

2.

OBJECTIVES

The RPET program aims to build the patent examination capabilities of participating
offices by improving the competency of examiners to conduct search and
exam1nation to Patent Cooperation Treaty (PCT) standards, embedding the learning
into the workplace, and providing offices the ability to align domestic practices with
international standards. l his will contribute to the granting of higher quality,
consistent patent rights and increased business confidence in the IP system.
3.

SCOPE

The RPET program provides intensive, comprehensive and competency-based
online patent examination training. The RPET curriculum, content and assessment
are based on IP Australia's existing examination training and quality framework. As a
competency-based program, trainees will be progressively assessed against defined
skill sets and international standards of practice. To be a 'competent' graduate of the

program, trainees need to consistently demonstrate the application of their skills and
knowledge to their own work. Attainment of competency will equip examiners with
the skills required to examine applications independently, consistently and to
international standards.
Each trainee will be supported by an experienced Australian patent examiner
throughout the RPET program. This includes one-on-one mentoring, on-the-job
training and continuous assessment of the trainee's progress. Trainees must also be
supported by a local supervisor in the role of mentor, allocated by DGIPR, for the
duration of the program. Completion of the program may take up to two years and
will depend on the trainee's ability to progress and attain the required competencies.

4.

RESPONSIBILITIES

IP Australia will:
i.

Allocate up to four experienced IP Australia examiners to work full-time as
program trainers. DGIPR trainees will work where possible with the same IP
Australia trainer for the duration of the program.

ii.

Continue to maintain appropriate learning resources and tools that can be
accessed remotely by trainees from DGIPR. This will give DGIPR trainees
flexibility to complete the program at their own pace and at the same time as
doing their local examination work.

iii.

Be responsible for the management of all program details. This includes:
content development and maintenance, scheduling of training activities, and
hosting up to two face-to-face intensive courses in Canberra, Australia.

Nominate traine.es for the RPET program that meet the following eligibility
criteria:


Have a mintmum ッセ@ two (2) years' experience in patent search and
examination and currently conduct substantive search and examination in
DGIPR.



Demonstrate a commitment to share knowledge gained from the program
with other examiners in DGIPR. Preferably, they will have a current
training role or are likely to have a training role in the future.



Demonstrate commitment to attain competency as quickly as possible,
within a maximum of two years.



Hold a degree in an area of technology, or a diploma together with
appropriate industry experience, that is relevant to the trainee's
examination specialisation.



Be fluent in English (both written and spoken) and possess sound
computer skills, including the ability to independently use the Internet,
word processing and emajl packages.



Be available to attend scheduled virtual classroom sess1ons throughout
the program and have the capacity to undertake course work whilst still
conducting examination tasks as specified by DGIPR.

Nominate a local supervisor for each DGIPR trainee. The local supervisor is
to meet the following eligibility criteria:

Have a minimum experience of five (5) years in substantive search and
examination, and' a direct role lin examiner training and/or continuous
improvement in DGIPR.



Preferably, have the capability

of Practice and work with IP Australia trainers to monitor and assess
trainee progress. This will require, on occasion, participation in

Be fluent in English (both written and spoken) and possess sound

Facilitate training on domestic legislation to trainees, as required, so they
can apply what they learn during the RPET program directly to their
domestic work where enhancing examination capability to international
standards is the aim .

SECURITY

The RPET program will be delivered predominantly online via a Virtual Learning
Environment (VLE) and require user name and password identify verification. To
ensure the security and authenticity of the program, DGIPR will need to ensure that
individuals accessing the RPET VLE are authorised users and the systems are being
used for the intended purpose of training and collaboration.

6.

CONFIDENTIAUTY

Without any prejudice to the laws, regulations and administrative policies that have
effect in each of the Participants' jurisdictions. the Participants will undertake 1o
observe the confidentiality of documents. information and other data received or
supplied between the Participants during the period of the implementation of this
MOU or any other agreements made pursuant to this MOU. If one of the Participants
wishes to transmit to a third party Confidential Information resulting from cooperative
activities under this MOU, the transmitting Participant must obtain prior consent from
the other Participant prior to any disclosure.
In this MOU, Confidential Information is defined in item 1 of the Schedule.
The provision of this paragraph will remain in effect between the participants
notwithstanding the termination of this MOU.

7.

FUNDING

The RPET program is funded by IP Australia and by the ASEAN-Australia-New
Zealand FTA (MNZFTA) Economic Cooperation Work Program. The RPET
program will finance travel costs including flights, accommodation and a daily
subsistence allowance for participation in one (1) face to face local supervisor
intensive workshop and one (1) face to face intensive training workshop for DGIPR
local supervisors and trainees respectively in Canberra, Australia. The Participants
will be responsible for any other expenses of their respective employees incurred
from the activities resulting from thi.s MOU.

8.

STATUS OF DEDICATED STAFF

Staff assigned by the Participants to the activities related to this MOU will remain
under the direction and authority of the institution to which they belong, without any
new employment relationship being created. Neither DGIPR nor IP Australia may be
considered as a substitute employer.

9.

AMENDMENT

This MOU may be amended with the written mutual consent of both Participants by
an exchange of letters, specifying the commencement date of the amendments.

10.

OWNERSHI'PAND PROCUREMENT

Intellectual Property in and ownership of any:
a.

material created by IP Australia for the purposes of the RPET and this MOU ;

b.

material provided or required to be provided by IP Australia as part of the RPET
or this MOU;

c.

equipment procured by IP Australia from the MNZFTA funds to enable
participation of DGIPR in t'he RPET;

d.

material derived at any time from the material or equipment referred to in
paragraphs a, b and c;

will vest in IP Australia .

Any hardware, licensed software or equipment purchased for DGIPR by IP Australia,
funds to enable participation in the RPET, as well as hard copies of training materials
provided by IP Australia, will! be owned by DGJPR once received by it. The ongoing
licence fees and any applicable maintenance and support for the software,
equipment and hardware will be the responsibility of DGIPR.
11.

SETTLEMENT OF DISPUTES

The Participants will endeavour to settle any dispute that may arise in connecNon
with the interpretation or implementation of this MOU by amicable consultations.
Should the latter fail, either pa·rticipant may terminate the MOU without notice period
and without prejudice to the possible application ッセ@ the last paragraph of Section 12
