Nota Kesepahaman ini (selanjutnya disebut dengan "Nota Kesepahaman")
dibuat antara Kementerian Keuangan Republik Indonesia (selanjutnya disebut
dengan "Kementerian Keuangan Indonesia") dan Kementerian Perdagangan
Republik
Rakyat Tiongkok
(selanjutnya
disebut dengan
"Kementerian
Perdagangan Tiongkok").
Menimbang:
Pemerintah Republik Rakyat Tiongkok berkomitmen untuk mengalokasikan
fasilitas pendanaan berupa Preferential Credit senilai USD10.000.000.000
(sepuluh miliar Dolar Amerika Serikat) untuk negara-negara anggota ASEAN .
Oleh karena itu, berdasarkan hukum dan peraturan yang berlaku di masingmasing
negara,

Kementerian
Perdagangan Tiongkok telar. menyepakati hal-hal sebagai berikut:
Pasal1
Kementerian Keuangan Indonesia dapat memanfaatkan fasilitas Preferential
Export Buyer's Credit dari Pemerintah Republik Rakyat Tiongkok (selanjutnya
disebut dengan "Fasilitas PBC'') sebagai bagian dari komitmen Fasilitas PBC
senilai USD1 0.000.000.000 (sepuluh miliar Dolar ..Amerika Serikat) yang
dialokasik.an untuk Negara-negara anggota ASEAN.
Pasal2
2.1. Fasilitas PBC sebagaimana disebutkan pada Pasal 1 akan dimanfaatkan
untuk pembiayaan kegiatan kerjasama infrastruktur yang potensial secara
ekonomis
sebagaimana
diusulkan
dalam
lampiran
dari

2.2. Kegiatan

This Memorandum of Understanding (hereinafter referred to as "MoU") is made
between the Ministry of Commerce of the People's Republic of China
(hereinafter referred to as "Ministry of Commence") and the Ministry of Finance
of the Republic of Indonesia (hereinafter referred to as "Ministry of Finance").
Whereas:
The Government of the People's Republic of China commits to allocate
financing facility of Preferential Credit amounting to USD 10,000,000,000 (ten
billions US Dollars) for ASEAN Member States.
Therefore, pursuant to the prevailing laws and regulations of their respective
country, Ministry of Commerce and Ministry of Finance have reached the
following understanding:
Article 1
Ministry of Finance may utilize Preferential Export Buyer's Credit Facility from
the Government of the People's Republic of China (hereinafter referred to as
"PBC Facility") as a part of commitment of Preferential Credit Facility amounting
to USD 10,000,000,000 (ten billions US Dollars) allocated for ASEAN Member
States.
Article 2
2.1 . PBC Facility as stipulated in the Article 1 will be utilized for financing
prospective economic infrastructure cooperation projects as proposed at
the attachment of this MoU (hereinafter referred to as "Projects").
2.2. Projects as listed at the attachment of this MoU are subject to changes in
line with the needs

3.1. The request for utilizing PBC Facility to finance Projects will be officially
submitted to Ministry of Commerce based on maturity and readiness the
respective Projects which cover technir.al , financial, and institutional
aspects including adequate land availability.

3.2. Procedure of submission of projects financing proposal, and procurement
of goods/services of the Projects will be conducted based on the PBC
Facility management regulations of the Government of China.
Article 4
4.1. Ministry of Commerce directly or through the Export-Import Bank of China
based on request of Ministry of Finance will update Ministry of Finance on
the available amount and applicable terms and conditions of PBC Facility.
4.2. The tenor, Interest Rate and other terms and conditions of PBC Facility for
the specific project will be specified in an individual project loan
agreement concluded by Ministry of Finance and tfle Export-Import Bank
of China.
Article 5
Detail implementation of this MoU will be arranged based on consultation
between Ministry of Commerce and Ministry of Finance.

Article 6
This MoU shall become effective upon signing.
Done in Beijing on 22ncJ August 2017, in duplicate in the Chinese, Indonesian
and English languages, all texts being equally authentic. In case of any
divergence, the English text will prevail.
