THERIGHTTOPRIVACY
Everyone,regardlessofsexualorientationorgenderidentity,isentitledtothe enjoyment of privacy without arbitrary or unlawful interference, including
withregardtotheirfamily,homeorcorrespondenceaswellastoprotection from unlawful attacks on their honour and reputation. The right to privacy
ordinarilyincludesthechoicetodiscloseornottodiscloseinformationrelating toone’ssexualorientationorgenderidentity,aswellasdecisionsandchoices
regardingbothone’sownbodyandconsensualsexualandotherrelationswith others.
Statesshall:
take all necessary legislative, administrative and other measures to ensure the right ofeachperson,regardlessofsexualorientationorgenderidentity,toenjoytheprivate
sphere, intimate decisions, and human relations, including consensual sexual activity amongpersonswhoareovertheageofconsent,withoutarbitraryinterference;
repealalllawsthatcriminaliseconsensualsexualactivityamongpersonsofthesamesex whoareovertheageofconsent,andensurethatanequalageofconsentappliestoboth
same-sexanddifferent-sexsexualactivity; ensurethatcriminalandotherlegalprovisionsofgeneralapplicationarenotappliedto
defactocriminaliseconsensualsexualactivityamongpersonsofthesamesexwhoare overtheageofconsent;
repealanylawthatprohibitsorcriminalisestheexpressionofgenderidentity,including throughdress,speechormannerisms,orthatdeniestoindividualstheopportunityto
changetheirbodiesasameansofexpressingtheirgenderidentity; releaseallthoseheldonremandoronthebasisofacriminalconviction,iftheirdetention
isrelatedtoconsensualsexualactivityamongpersonswhoareovertheageofconsent,or isrelatedtogenderidentity;
ensuretherightofallpersonsordinarilytochoosewhen,towhomandhowtodisclose information pertaining to their sexual orientation or gender identity, and protect all
personsfromarbitraryorunwanteddisclosure,orthreatofdisclosureofsuchinformation byothers.

Nooneshallbesubjectedtoarbitraryarrestordetention.Arrestordetentionon thebasisofsexualorientationorgenderidentity,whetherpursuanttoacourt
order or otherwise, is arbitrary. All persons under arrest, regardless of their sexualorientationorgenderidentity,areentitled,onthebasisofequality,tobe
informedofthereasonsforarrestandthenatureofanychargesagainstthem, tobebroughtpromptlybeforeajudicialoficerandtobringcourtproceedingsto
determinethelawfulnessofdetention,whetherornotchargedwithanyoffence.
Statesshall:
takeallnecessarylegislative,administrativeandothermeasurestoensurethatsexual orientation or gender identity may under no circumstances be the basis for arrest or
detention,includingtheeliminationofvaguelywordedcriminallawprovisionsthatinvite discriminatoryapplicationorotherwiseprovidescopeforarrestsbasedonprejudice;
takeallnecessarylegislative,administrativeandothermeasurestoensurethatallpersons underarrest,regardlessoftheirsexualorientationorgenderidentity,areentitled,onthe
basisofequality,tobeinformedofthereasonsforarrestandthenatureofanycharges againstthem,andwhetherchargedornot,tobebroughtpromptlybeforeajudicialoficer
andtobringcourtproceedingstodeterminethelawfulnessofdetention; undertakeprogrammesoftrainingandawareness-raisingtoeducatepoliceandother
lawenforcementpersonnelregardingthearbitrarinessofarrestanddetentionbasedona person’ssexualorientationorgenderidentity;
maintain accurate and up to date records of all arrests and detentions, indicating the date,locationandreasonfordetention,andensureindependentoversightofallplacesof
detentionbybodiesthatareadequatelymandatedandequippedtoidentifyarrestsand detentionsthatmaybemotivatedbythesexualorientationorgenderidentityofaperson.
THERIGHTTOAFAIRTRIAL
Everyoneisentitledtoafairandpublichearingbyacompetent,independent andimpartialtribunalestablishedbylaw,inthedeterminationoftheirrights
and obligations in a suit at law and of any criminal charge against them, withoutprejudiceordiscriminationonthebasisofsexualorientationorgender
identity.
