Statesshall:
takeallnecessarylegislative,administrativeandothermeasurestoprohibitandeliminate prejudicial treatment on the basis of sexual orientation or gender identity at every
stageofthejudicialprocess,incivilandcriminalproceedingsandallotherjudicialand administrativeproceedingswhichdeterminerightsandobligations,andtoensurethatno
one’scredibilityorcharacterasaparty,witness,advocateordecision-makerisimpugned byreasonoftheirsexualorientationorgenderidentity;
takeallnecessaryandreasonablestepstoprotectpersonsfromcriminalprosecutions orcivilproceedingsthataremotivatedwhollyorinpartbyprejudiceregardingsexual
orientationorgenderidentity; undertake programmes of training and awareness-raising for judges, court personnel,
prosecutors, lawyers and others regarding international human rights standards and principlesofequalityandnon-discrimination,includinginrelationtosexualorientation
andgenderidentity.
THERIGHTTOTREATMENTWITHHUMANITY WHILEINDETENTION
Everyonedeprivedoflibertyshallbetreatedwithhumanityandwithrespect fortheinherentdignityofthehumanperson.Sexualorientationandgender
identityareintegraltoeachperson’sdignity.
Statesshall:
ensurethatplacementindetentionavoidsfurthermarginalisingpersonsonthebasisof sexualorientationorgenderidentityorsubjectingthemtoriskofviolence,ill-treatment
orphysical,mentalorsexualabuse; Provide adequate access to medical care and counselling appropriate to the needs of
thoseincustody,recognisinganyparticularneedsofpersonsonthebasisoftheirsexual orientation or gender identity, including with regard to reproductive health, access to
hiVaidsinformationandtherapyandaccesstohormonalorothertherapyaswellasto gender-reassignmenttreatmentswheredesired;
ensure, to theextentpossible, thatallprisonersparticipateindecisionsregarding the placeofdetentionappropriatetotheirsexualorientationandgenderidentity;
Putprotectivemeasuresinplaceforallprisonersvulnerabletoviolenceorabuseonthe basisoftheirsexualorientation,genderidentityorgenderexpressionandensure,sofar
asisreasonablypracticable,thatsuchprotectivemeasuresinvolvenogreaterrestriction oftheirrightsthanisexperiencedbythegeneralprisonpopulation;

ensurethatconjugalvisits,wherepermitted,aregrantedonanequalbasistoallprisoners anddetainees,regardlessofthegenderoftheirpartner;
Providefortheindependentmonitoringofdetentionfacilitiesbythestateaswellasby non-governmentalorganisationsincludingorganisationsworkinginthespheresofsexual
orientationandgenderidentity; undertakeprogrammesoftrainingandawareness-raisingforprisonpersonnelandall
otheroficialsinthepublicandprivatesectorwhoareengagedindetentionfacilities, regarding international human rights standards and principles of equality and non-
discrimination,includinginrelationtosexualorientationandgenderidentity.
THERIGHTTOFREEDOMFROMTORTUREAND CRUEL,INHUMANORDEGRADINGTREATMENT
ORPUNISHMENT
Everyone has the right to be free from torture and from cruel, inhuman or degradingtreatmentorpunishment,includingforreasonsrelatingtosexual
orientationorgenderidentity.
Statesshall:
takeallnecessarylegislative,administrativeandothermeasurestopreventandprovide protection from torture and cruel, inhuman or degrading treatment or punishment,
perpetratedforreasonsrelatingtothesexualorientationorgenderidentityofthevictim, aswellastheincitementofsuchacts;
takeallreasonablestepstoidentifyvictimsoftortureandcruel,inhumanordegrading treatmentorpunishment,perpetratedforreasonsrelatingtosexualorientationorgender
identity, and offer appropriate remedies including redress and reparation and, where appropriate,medicalandpsychologicalsupport;
undertakeprogrammesoftrainingandawareness-raisingforpolice,prisonpersonneland allotheroficialsinthepublicandprivatesectorwhoareinapositiontoperpetrateorto
preventsuchacts.

THERIGHTTOPROTECTIONFROMALLFORMS OFEXPLOITATION,SALEANDTRAFFICKINGOF
HUMANBEINGS
Everyone is entitled to protection from traficking, sale and all forms of exploitation,includingbutnotlimitedtosexualexploitation,onthegrounds
ofactualorperceivedsexualorientationorgenderidentity.Measuresdesigned to prevent traficking shall address the factors that increase vulnerability,
including various forms of inequality and discrimination on the grounds of actual or perceived sexual orientation or gender identity, or the expression
oftheseorotheridentities.Suchmeasuresmustnotbeinconsistentwiththe humanrightsofpersonsatriskofbeingtraficked.
Statesshall:
take all necessary legislative, administrative and other measures of a preventive and protectivenatureregardingthetraficking,saleandallformsofexploitationofhuman
beings, including but not limited to sexual exploitation, on the grounds of actual or perceivedsexualorientationorgenderidentity;
ensure that any such legislation or measures do not criminalise the behaviour of, stigmatise,orinanyotherway,exacerbatethedisadvantageofthosevulnerabletosuch
practices; establish legal, educational and social measures, services and programmes to address
factorsthatincreasevulnerabilitytotraficking,saleandallformsofexploitation,including but not limited to sexual exploitation, on the grounds of actual or perceived sexual
orientationorgenderidentity,includingsuchfactorsassocialexclusion,discrimination, rejectionbyfamiliesorculturalcommunities,lackofinancialindependence,homelessness,
discriminatorysocialattitudesleading tolowself-esteem,andlackofprotectionfrom discriminationinaccesstohousing,accommodation,employmentandsocialservices.
