may be, and commonly is, compounded by discrimination on other grounds includinggender,race,age,religion,disability,healthandeconomicstatus.
Statesshall:
embodytheprinciplesofequalityandnon-discriminationonthebasisofsexualorientation andgenderidentityintheirnationalconstitutionsorotherappropriatelegislation,ifnot
yet incorporated therein, including by means of amendment and interpretation, and ensuretheeffectiverealisationoftheseprinciples;
repeal criminal and other legal provisions that prohibit or are, in effect, employed to prohibitconsensualsexualactivityamongpeopleofthesamesexwhoareovertheageof
consent,andensurethatanequalageofconsentappliestobothsame-sexanddifferent- sexsexualactivity;
adoptappropriatelegislativeandothermeasurestoprohibitandeliminatediscrimination inthepublicandprivatespheresonthebasisofsexualorientationandgenderidentity;
takeappropriatemeasurestosecureadequateadvancementofpersonsofdiversesexual orientationsandgenderidentitiesasmaybenecessarytoensuresuchgroupsorindividuals
equalenjoymentorexerciseofhumanrights.suchmeasuresshallnotbedeemedtobe discriminatory;
inalltheirresponsestodiscriminationonthebasisofsexualorientationorgenderidentity, takeaccountofthemannerinwhichsuchdiscriminationmayintersectwithotherforms
ofdiscrimination; takeallappropriateaction,includingprogrammesofeducationandtraining,withaview
toachievingtheeliminationofprejudicialordiscriminatoryattitudesorbehaviourswhich arerelatedtotheideaoftheinferiorityorthesuperiorityofanysexualorientationor
genderidentityorgenderexpression.
