Not hing in t he pr esent Convent ion shall affect t he r ight of each St at e Par t y t o est ablish t he cr it er ia gover ning admission of migr ant w or ker s and member s of t heir families. Concer ning ot her mat t er s r elat ed t o t heir legal sit uat ion and tr eat ment as migr ant w or ker s and member s of t heir families, St at es Par t ies shall be subject t o t he limit at ions set for t h in t he pr esent Convent ion.

Ar ticle 80

Not hing in t he pr esent Convent ion shall be int er pr et ed as impair ing t he pr ovisions of t he Char t er of t he Unit ed Nat ions and of t he const it ut ions of t he specialized agencies w hich define t he r espect ive r esponsibilit ies of t he var ious or gans of t he Unit ed Nat ions and of t he specialized agencies in r egard t o t he mat t er s dealt w it h in t he pr esent Convent ion.

Ar ticle 81

1. Not hing in t he pr esent Convent ion shall affect mor e favour able r ight s or fr eedoms gr ant ed t o migr ant w or ker s and member s of t heir families by vir t ue of :

(a) The law or pr act ice of a St at e Par t y; or (b) Any bilat er al or mult ilat er al t r eat y in for ce for t he St at e

Par t y concer ned.

2. Not hing in t he pr esent Convention may be inter pr et ed as implying for any St at e, gr oup or per son any r ight to engage in any act ivit y or per for m any act t hat w ould impair any of t he r ights and fr eedoms as set for t h in t he pr esent Convent ion.

Ar ticle 82

The r ight s of migr ant w or ker s and member s of t heir families pr ovided for in t he pr esent Convent ion may not be r enounced. It shall not be per missible t o exer t any for m of pr essur e upon migr ant w or ker s and member s of t heir families w it h a view t o t heir r elinquishing or for egoing any of t he said r ight s. It shall not

be possible t o der ogat e by cont r act fr om r ight s r ecognized in t he pr esent Convention. St at es Par t ies shall t ake appr opr iat e measur es t o ensur e t hat t hese pr inciples ar e r espect ed.

Ar ticle 83

Each St at e Par t y t o t he pr esent Convent ion under t akes : (a) To ensur e t hat any per son w hose r ight s or fr eedoms as

her ein r ecognized ar e violat ed shall have an effect ive r emedy, not w it hst anding t hat t he violat ion has been commit t ed by per sons act ing in an official capacit y;

(b) To ensur e t hat any per sons seeking such a r emedy shall have his or her claim r eview ed and decided by compet ent judicial, administr at ive or legislat ive aut hor it ies, or by any ot her compet ent aut hor it y pr ovided for by t he legal syst em of t he St at e, and t o develop t he possibilit ies of judicial r emedy;

(c) To ensur e t hat t he compet ent aut hor it ies shall enfor ce such r emedies w hen gr ant ed.

Ar ticle 84

Each St at e Par t y under t akes t o adopt t he legislat ive and ot her measur es t hat ar e necessar y t o implement t he pr ovisions of t he pr esent Convent ion.
