b. Pada tanggal 12 April 2012, PT Eramitra Agrolestari “EMAL”, Entitas Anak, melakukan gugatan hukum
perdata atas penyerobotan lahan, pendirian bangunan, penempatan alat-alat berat serta
penanaman tanaman kelapa sawit yang dilakukan PT Indo Agroganda Lestari di atas tanah Hak
Guna Usaha HGU milik EMAL seluas 3.000 Ha. PT Indo Agroganda Lestari diminta untuk segera
memindahkan peralatan serta menghentikan proses penanaman kelapa sawit tersebut. Selain itu,
EMAL menuntut beban ganti kerugian sebesar Rp121,03 miliar untuk kerugian materiil dan Rp100
miliar untuk kerugian non materiil. b. On April 12, 2012, PT Eramitra Agrolestari
EMAL, a Subsidiary, filed a civil lawsuit over annexation of land, construction of building,
placement of heavy equipment and planting of palm oil trees by PT Indo Agroganda Lestari on EMAL
land rights HGU covering 3,000 hectares. PT Indo Agroganda Lestari asked to move the equipment and
stop the planting process. In addition, EMAL demanded compensation expense amounting to
Rp121.03 billion for material losses and Rp100 billion for non-material losses.
Pengadilan Negeri Sarolangun memenangkan gugatan yang diajukan oleh EMAL, tetapi putusan
tersebut dibatalkan oleh Pengadilan Tinggi Jambi. EMAL telah mengajukan Kasasi ke Mahkamah
Agung MA dan putusan MA adalah memenangkan EMAL.
The District Court of Sarolangun has issued the decision for this case in favor of EMAL. However, it
was dismissed by the High Court of Jambi. EMAL has filed its appeal against the decision to the
Supreme Court, which has issued the decision for this case in favor of EMAL.
c. Pada tanggal 23 Oktober 2012, Jasman bin Musa mengajukan gugatan ke Pengadilan Negeri
Menggala, Lampung agar PT Huma Indah Mekar, Entitas Anak, memberikan ganti rugi lahan seluas
225 ha. Pada tanggal 3 Desember 2012, Pengadilan Negeri menolak gugatan ini seluruhnya. Putusan ini
dikuatkan oleh Pengadilan Tinggi Tanjung Karang pada tanggal 16 September 2013.
c. On October 23, 2012, Jasman bin Musa filed a civil lawsuit at the District Court of Menggala, Lampung
against PT Huma Indah Mekar, a Subsidiary, to pay for compensation of land with an area of
225 hectares. On December 23, 2012, the District Court dismissed the claim. This decision was
confirmed by the High Court of Tanjung Karang on September 16, 2013.
Pada tanggal 6 November 2013, Jasman bin Musa mengajukan kasasi di Mahkamah Agung. Sampai
dengan tanggal laporan keuangan konsolidasian interim, tuntutan ini masih dalam status pemeriksaan
di tingkat kasasi. On November 6, 2013, Jasman bin Musa submitted
an appeal to the Supreme Court which, as of the date of the interim consolidated financial statements, is
still under examination.
d. Pada tanggal 16 Juli 2014, Surya Indra Kusuma atas nama Kelompok Tani Yakin Makmur mengajukan
gugatan ke Pengadilan Negeri Sengeti Jambi agar PT Sumbertama Nusapertiwi “SNP”, Entitas Anak,
mengembalikan tanah seluas 4.829 ha dalam keadaan kosong dan menuntut ganti rugi sebesar Rp598,80
miliar. d. On July 16, 2014, Surya Indra Kusuma, on behalf of
Kelompok Tani Yakin Makmur, filed a civil lawsuit at the District Court of Sengeti Jambi against
PT Sumbertama Nusapertiwi “SNP”, a Subsidiary, to repatriate the land with an area of 4,829 hectares
in the empty state and demanding compensation amounting to Rp598.80 billion.
Pengadilan Negeri Sengeti Jambi memenangkan gugatan yang diajukan oleh Kelompok Tani Yakin
Makmur. SNP telah mengajukan banding ke Pengadilan Tinggi Jambi dan pada tanggal 14 April
2015, Pengadilan Tinggi Jambi telah membatalkan putusan Pengadilan Negeri Sengeti Jambi tersebut.
The District Court of Sengeti Jambi issued its decision for this case in favor of Kelompok Tani
Yakin Makmur. SNP has filed its appeal against the decision to the High Court of Jambi, which on
April 14, 2015, has revoked the decision of the District Court of Sengeti Jambi.

38. FINANCIAL RISK MANAGEMENT OBJECTIVES AND POLICIES
Tujuan, kebijakan dan proses secara umum General objectives, policies and processes
Kelompok Usaha dipengaruhi oleh berbagai risiko keuangan yaitu; risiko pasar termasuk risiko mata uang
asing, risiko suku bunga dan risiko harga komoditas, risiko kredit dan risiko likuiditas. Tujuan manajemen
risiko Kelompok Usaha secara keseluruhan adalah untuk secara efektif mengelola risiko tersebut dan
meminimalkan dampak negatif terhadap kinerja keuangan tanpa terlalu mempengaruhi daya saing
dan fleksibilitas Kelompok Usaha. Strategi untuk mendukung tujuan dan sasaran dari manajemen risiko
diwujudkan melalui pembentukan dan pengembangan budaya risiko yang kuat, penerapan praktik Tata Kelola
Perusahaan, pelestarian nilai-nilai kepatuhan terhadap regulasi, infrastruktur yang memadai, serta proses kerja
yang terstruktur dan sehat. The Group is affected by various financial risks namely;
market risk including foreign currency risk, interest rate risk and commodity price risk, credit risk and
liquidity risk. The Group’s overall risk management objectives are to effectively manage these risks and
minimize potential adverse effects on its financial performance without unduly affecting the Groups
competitiveness and flexibility. Strategies to support the goals and objectives of risk management is actualized
through the formation and development of a strong risk culture, the implementation of Good Corporate
Governance practices, preserving the values of compliance with regulations, adequate infrastructure, as
well as structured and healthy working processes.
Dewan Direksi dan Dewan Komisaris Kelompok Usaha, melalui Komite Manajemen Risiko, memiliki tanggung
jawab keseluruhan untuk penciptaan dan pengawasan atas kebijakan manajemen risiko korporasi Kelompok
Usaha dan secara aktif terlibat dalam penilaian, perencanaan, peninjauan dan persetujuan dari semua
risiko dalam organisasi Kelompok Usaha. The Group’s Board of Directors and Board of
Commissioners, through its Risk Management Committee, have overall responsibility for the creation
and oversight of the Group’s corporate risk management policy and are actively involved in the assessment,
planning, review and approval of all the risks in the Group’s organization.
Kelompok Usaha menerapkan Enterprise Risk Management ERM yang dikelola oleh Divisi
Enterprise Audit Risk Management EARM, khususnya Departemen Enterprise Risk Management
ERM, yang bertanggung jawab atas koordinasi, fasilitasi, evaluasi dan penerapan Sistem Manajemen
Risiko Korporasi. Disamping itu, Departemen ERM juga memastikan bahwa Risk Control Self Assessment
RCSA telah diterapkan oleh para pemilik risiko. The Group implements an Enterprise Risk Management
ERM which is administered by the Enterprise Audit Risk Management EARM Division, particularly by the
Enterprise Risk Management ERM Department, which is responsible for the coordination, facilitation,
evaluation and implementation of the Group’s Corporate Risk Management System. In addition, the
ERM department also ensures that the Risk Control Self Assessment RCSA is being implemented by risk
owners.

Risiko Kredit Credit Risk
Risiko kredit adalah risiko kerugian keuangan yang timbul jika pelanggan gagal memenuhi kewajiban
kontraktualnya kepada Perusahaan. Kelompok Usaha memiliki risiko kredit yang berasal dari kas dan setara
kas, piutang usaha, piutang lain-lain, piutang plasma, piutang pihak berelasi dan dana yang dibatasi
penggunaannya. Credit risk is the risk of suffering financial loss, should
any of the Group’s customers and other third parties fail to fulfill their contractual obligations to the Group. The
Group’s credit risk arises from cash and cash equivalents, trade receivables, other receivables, due
from plasma, due from related parties, investments in equity securities and restricted funds.
