Pada 26 Juli 2012, Perseroan menandatangani sebuah MoU dengan Gubernur Sulawesi Tengah dan Bupati Morowali. Salah satu hal penting di dalam MoU adalah Bupati akan bertanggungjawab dalam penyelesaian hal-hal tumpang tindih IUP di Kabupaten Morowali. With regard to the issue of overlapping IUPs within the CoW areas in Central Sulawesi, there has been continuing dialogue and correspondence with the relevant governmental institutions, including with the Regent of Morowali, the Governor of Central Sulawesi, the Director General of Minerals and Coal, and the Ministry of Environment. In addition, on July 26, 2012, the Company signed a MoU with the Governor of Central Sulawesi and The Regent of Morowali. One of the key points of the MoU is that the Regent shall be responsible for settlement of the IUP overlapping issue in the Morowali Regency. Furthermore, some authorities have started preliminary investigation on this matter. The Company is monitoring the developments on the site and preparing for appropriate legal actions should they be deemed necessary. Karena tidak ada perkembangan dalam hal tumpang-tindih IUP, Gubernur Sulawesi Tengah mengirimkan surat kepada Bupati Morowali pada 27 Desember 2012, menginstruksikan kepada sang Bupati untuk secepatnya mencabut IUP yang tumpang-tindih dan untuk menghentikan segala aktivitas dari pemegang IUP; keduanya harus sudah selesai pada Februari 2013. Bupati Morowali mengeluarkan ijin lokasi pada 18 Desember 2012 meliputi area seluas 578 hektar. Perseroan telah memperoleh 60 hektar dari tanah tersebut. Pada 12 Februari 2013, Bupati mengirimkan surat kepada sebelas pemegang IUP menginstruksikan mereka agar menghentikan segala kegiatan penambangan dan ekspor bijih dalam waktu dua minggu; jika tidak Pemerintah Daerah Morowali akan menghentikan kegiatan secara permanen danatau mencabut IUP. Namun demikian, tidak terdapat perubahan signifikan di lapangan sebagai tanggapan atas surat tersebut diatas. Perseroan masih mengamati perkembangan atas hal ini. As there has been no significant development on overlapping IUPs, the Governor of Central Sulawesi sent a letter to the Regent of Morowali on December 27, 2012, instructing the Regent to immediately revoke the overlapping IUPs and to stop any activities by the IUP holders; both must be completed by February 2013. The Regent of Morowali issued a location permit on December 18, 2012 covering area of 578 Ha. The Company has acquired 60 Ha of the land in this area. On February 12, 2013, the Regent sent a letter to eleven IUP holders instructing them to stop all mining and ore export activities within two weeks; otherwise the Regional Government of Morowali will permanently stop the activities andor revoke the IUPs.
