PERMASALAHAN HUKUM 1.
Komisi Pengawas Persaingan Usaha
Sehubungan dengan Putusan Perkara No. 04 KPPU-L2012, tanggal 25 April 2013, Perseroan telah
dinyatakan melanggar pasal 22 Undang-undang no. 5 Tahun 1999, tentang Larangan Praktek Monopoli dan
Persaingan Usaha Tidak Sehat, atas Tender Pembangunan Gedung Perawatan dan Pelayanan Kelas I dan VIP Rumah
Sakit Sulawesi Tenggara Tahun Anggaran 2011.
Terhadap putusan tersebut pada tanggal 10 Mei 2013, Perseroan selaku Terlapor III telah menempuh upaya
hukum dengan membuat dan memasukkan keberatan terhadap putusan KPPU tersebut di Pengadilan Negeri
Jakarta Selatan.
Saat ini Perkara tersebut masih dalam proses peradilan.
2. Badan Abritrase Nasional Indonesia
a. Perseroan mengajukan permohonan penyelesaian sengketa melalui Badan Abritrase Nasional dengan
Nomor Perkara 526VIARB-BANI2013 tanggal 31 Mei 2013, sehubungan dengan Perbuatan Wan
Prestasi PT Karya Bersama Takarob terhadap Proyek Cirebon Super Blok, karena tidak membayar tagihan
pembayaran berdasarkan kontrak No. 010PKS-CSB III tanggal 18 Februari 2011.
Saat ini Perkara tersebut masih dalam proses peradilan di Abritrase.
b. Perseroan mengajukan permohonan penyelesaian sengketa melalui Badan Abritrase Nasional dengan
Nomor Perkara 548XIIARB-BANI2013, sehubungan dengan Perbuatan Wan Prestasi PT. Truba Jaya
Engineering dalam rangka melaksanakan pekerjaan pembangunan pekerjaan Sipil dan Infrastruktur
dalam Proyek Proyek PLTU 2 Jawa Barat 3X350 MW Pembangkit Tenaga Listrik Palabuhanratu, berdasar
Contract Agreement For Civil Works Coal Handling System And Auxiliary System Package II Package

PLTU 3X350 MW Palabuhanratu tanggal 1 Mei 2009.
Saat ini Perkara tersebut masih dalam proses peradilan di Abritrase.
3. Pengadilan Negeri Jakarta Selatan
a. Dalam Perkara Perseroan Perbuatan Wan Prestasi PT Karya Bersama Takarob terhadap Proyek Cirebon
Super Blok mengajukan gugatan di pengadilan Negeri Jakarta Selatan, sehubungan dengan Perbuatan Wan
Prestasi PT Karya Bersama Takarob terhadap Proyek Pembangunan Struktur Hotel Condotel Cirebon.
LITIGATION CASES 1.
Commission for the Supervision of Business Competition KPPU
Pursuant to the Case Indictment No. 04KPPU-L2012, dated 25 April 2013, the Company has been indicted
for infringement of Article 22 Law no. 5 of 1999, on the Prohibition of Monopolistic Practices and Unfair
Business Competition, with regard to the Tender for the Construction of the First Class and VIP Treatment Ward
of the South East Sulawesi Hospital, during Fiscal Year 2011.
Upon this indictment, on 10 May 2013, the Company as Defendant III has pursued a legal course by iling an
objection to the KPPU indictment at the South Jakarta District Court.
The case is currently undergoing due process.
2. Indonesian National Arbitrary Board
a. The Company has iled for a conlict settlement through the National Arbitrary Board with Case
Number 526VIARB-BANI2013 dated 31 May 2013, pertaining to the default by PT Karya Bersama Takarob
over the Cirebon Super Blok Project, by failing to settle for payment invoices based on contract No.
010PKS-CSBIII dated 18 February 2011.
The case is currently proceeding at the Arbitration Court.
b. The Company has iled for a conlict settlement through the National Arbitrary Board with Case
Number 548XIIARB-BANI2013, pertaining to the default by PT Truba Jaya Engineering in carrying
out construction works on the Civil Engineering and Infrastructure of the 3x350 MW Palabuhanratu
Steam-ired Power Plant 2 Project in West Java, based on the Contract Agreement For Civil Works
Coal Handling System And Auxiliary System Package II Package III PLTU of said project, dated 1 May
2009.
The case is currently proceeding at the Arbitration Court.
3. South Jakarta District Court
a. In the case of default by PT Karya Bersama Takarob over the Cirebon Super Block Project, the Company
has iled a lawsuit against said company at the South Jakarta District Court, pertaining to the default by PT
Karya Bersama Takarob over the construction of the Cirebon Condotel Hotel Structure.

The case is currently undergoing due process. b. PT Bangun Makmur Sejati has iled a lawsuit against
the Company at the South Jakarta District Court with Case No. 642Pdt.G2013PN.JKT. Sel. dated 1
November 2013.
The case is currently undergoing due process.
4. East Jakarta District Court
Pertaining to the construction of the new airport at Sungai Siring, Samarinda, PT Nusa Cipta Realitindo NCR has
iled a lawsuit against the Governor of East Kalimantan at the East Jakarta District Court with Case No. 304
Pdt.G2013PN.Jkt.Tim. In this case, the Company is listed as Defendant IV.
The case is currently undergoing due process.
