Nuraini Udaya, cs. penggugat mengklaim sebagai pemilik 118 bidang tanah berdasarkan sertifikat Hak Milik danatau Akta Jual Beli di Desa Pulo Ampel dan Desa Margasari, Kecamatan Pulo Ampel Kabupaten Serang yang berada tumpang tindih dengan HPL Perusahaan dan Ir. Nuraini Udaya menyatakan tidak pernah menjual tanahnya kepada Perusahaan sehingga mendalilkan bahwa sertifikat HPL tersebut mengandung cacat hukum dan cacat administrasi. Ir. Nuraini Udaya and group the plaintiff claimed as the owner of 118 plots of land based on Right of Ownership Certificates andor Deeds of Sale and Purchase located at Pulo Ampel Village and Margasari Village, Pulo Ampel Sub-District the District of Serang which was overlapping with the HPL Certificates held under the Company’s name and Ir. Nuraini Udaya claimed that she had never sold her land to the Company. Therefore she claimed that such HPL Certificates were subject to legal and administrative faults. Ir. Nuraini Udaya menyatakan bahwa Perusahaan secara melawan hukum telah merampas hak dan melakukan penyerobotan tanah, melakukan penguasaan fisik, memanfaatkan dan mengambil keuntungan atas tanah-tanah milik Ir. Nuraini Udaya, cs. Ir. Nuraini Udaya claimed that the Company had illegally taken over the rights, land possession, physical control, used and taken benefit of the land owned by Ir. Nuraini Udaya and group. Ir. Nuraini Udaya menyatakan bahwa Kantor Pertanahan mengakui adanya tumpang tindih HPL No. 1 dan No. 2 dengan tanah-tanah milik Penggugat Surat No. 300.7-4512010 tanggal 22 Januari 2010 perihal Klarifikasi Status Tanah 565 Sertifikat Hak Milik dan salinan Peta Lokasi Tanah yang terletak di Desa Pulo Ampel dan Desa Margasari Kecamatan Bojonegara Kabupaten Serang. Ir. Nuraini Udaya claimed that the Land Office had admitted the existence of overlapping of HPL No. 1 and No. 2 with lands owned by the Plaintiffs Letter No. 300.7-4512010 dated January 22, 2010 regarding Clarifications on Status of Lands 565 Right of Ownership and copy of Land Location Map situated at Pulo Ampel Village and Margasari Village, Sub-District of Bojonegara, District of Serang. Kantor Pertanahan Kabupaten Serang telah salah mengeluarkan sertifikat HPL karena dianggap sudah mengetahui adanya sertifikat yang dimiliki oleh para Penggugat, sehingga dikategorikan telah melakukan perbuatan melanggar hukum. Land Office of Serang District has mistakenly issued HPL Certificate, on the grounds that the Land Office was deemed to have known the existence of certificates owned by the Plaintiffs.
